Membership Terms of Use
Please read these Membership Terms of Use carefully before subscribing to the Growth Lab Membership, operated by Elevated Education Co LLC (“Company”).
By enrolling in the Growth Lab Membership, you (“Member,” “You,” or “Your”) agree to be legally bound by these Terms of Use (“Agreement”), which govern your access to and participation in the Growth Lab Membership (“Membership”). If you do not agree to these terms, please do not enroll or discontinue use immediately.
Access to the Membership
Upon enrollment in the Growth Lab Membership, you will receive access to the Growth Lab content, resources, and community features as outlined at the time of purchase. Access is contingent upon successful payment and continued compliance with these Terms.
The Growth Lab Membership includes:
- Two monthly training drops
- Two corresponding implementation resources
- Ability to comment directly under trainings for implementation support
- Access to the private Growth Lab community
- The ability to submit up to 2 coaching questions per month within designated community threads
The Company does not guarantee specific outcomes, response times, or individualized results but will make reasonable efforts to provide ongoing educational support. The Company reserves the right to update, modify, or replace content, community structure, or delivery methods, provided that the core intent and value of the Membership remain intact.
Consent
By purchasing the Growth Lab Membership, you confirm your consent to abide by the terms set forth in this Agreement.
Disclaimer
The Membership is intended for educational purposes for service-based business owners and entrepreneurs. It does not replace professional, legal, financial, or mental health advice. You acknowledge that outcomes depend on your individual application of the content and that no guarantees are made regarding business results.
Payment Terms
Membership payments are billed on a monthly basis according to your individual billing cycle. Your billing cycle begins on the date you sign up. For example, if you join on the 10th of the month, your payment will automatically renew on the 10th of each following month.
If an automatic payment fails, our system will retry the payment 5 days later.
If that second attempt fails, a third and final retry will occur 5 days after the second attempt.
If the payment cannot be successfully collected by the third retry, your membership access will be revoked immediately. To regain access, you’ll need to re-enroll and submit a new payment at the current membership rate.
You are responsible for ensuring that your payment method remains active and up to date to avoid any interruption of service.
Free Trial Offer
The Company may offer a one-time 14-day free trial for new Members enrolling in the Growth Lab Membership. Eligibility is limited to first-time Members only. The free trial provides immediate access to Membership content.
At the end of the 14-day free trial, the Membership will automatically convert to a paid subscription at the then-current monthly rate unless canceled prior to the trial expiration.
Free Trial Billing Authorization
By signing up for a free trial, you authorize the Company to charge the payment method provided on file at the conclusion of the 14 day trial period. The Company is not required to send a reminder prior to the trial converting to a paid subscription. You are responsible for canceling before the trial ends if you do not wish to continue.
By proceeding with enrollment, you acknowledge that failure to cancel prior to the trial expiration constitutes authorization for payment and waives any right to dispute the charge as unauthorized.
Free Trial Cancellation Policy
You may cancel your Membership at any time during the 14 day free trial through your Kajabi account settings. If canceled before the trial period ends, you will not be charged and your access will terminate at the end of the trial.
Failure to cancel prior to the end of the trial period will result in automatic billing, and all standard Membership payment and refund policies will apply.
Cancellation Policy
You may cancel your Membership at any time through your Kajabi account settings. Cancellation prevents future billing but does not issue refunds for current or previous billing periods. Cancellations must be completed prior to the next billing date to avoid charges for the subsequent billing cycle.
Refund Policy
Due to the digital and instant-access nature of the Membership content, no refunds will be issued under any circumstances once your purchase is processed. Once a free trial converts to a paid Membership, no refunds will be issued for any charges incurred. No prorated refunds or credits will be provided for unused time, partial months, or unused content.
Intellectual Property
All Membership content, including videos, PDFs, templates, and training materials, are the sole property of the Company. You may not reproduce, share, resell, or distribute any content from the Membership. Violation of this clause will result in immediate termination of your access without refund.
Support and Feedback
Growth Lab members may ask questions directly within the training modules via comments for feedback and implementation support. The Company does not guarantee a specific response time but will make reasonable efforts to reply promptly.
Community Conduct
The Company reserves the right to remove any Member from the Membership or community spaces for disruptive, abusive, discriminatory, or inappropriate behavior without refund.
Content Evolution Disclaimer
Training topics, formats, and delivery methods may evolve over time to reflect industry changes and Member needs.
Assumption of Risk
You are responsible for how you apply the materials in your own business. The Company is not liable for the success or failure of your actions based on Membership content. Results are not guaranteed.
Limitation of Liability
In no event will the Company be liable for any indirect, special, or consequential damages including but not limited to lost profits, business interruptions, or data loss, arising out of your use of the Membership content.
Confidentiality & Non-Disclosure
You agree not to share, copy, or redistribute any of the content or communications from inside the Membership. All materials are confidential and intended solely for personal use.
Testimonial & Photo Release
You consent to the Company’s right to use any testimonial, review, or communication you voluntarily submit (written or visual) for marketing purposes. No compensation will be provided.
Indemnification
You agree to hold harmless and indemnify the Company for any claims, liabilities, damages, or expenses arising from your participation or misuse of the Membership materials.
Force Majeure
Neither party shall be held liable for delays or failure in performance due to events outside of reasonable control, including but not limited to natural disasters, internet failures, government actions, or pandemics.
Severability
If any provision of this Agreement is found to be unenforceable, the remainder shall remain in full force and effect.
Governing Law & Jurisdiction
This Agreement shall be governed by and construed in accordance with the laws of the State of Arizona, United States, without regard to conflict of law principles. Any disputes arising under this Agreement shall be resolved exclusively in the state or federal courts located in Arizona.
Entire Agreement
This Agreement represents the entire understanding between the Company and You regarding your Membership and supersedes all prior agreements.
